Contraception mandate outrages religious groups (AP)

The Obama administration's decision requiring church-affiliated employers to cover birth control was bound to cause an uproar among Roman Catholics and members of other faiths, no matter their beliefs on contraception.

The regulation, finalized a week ago, raises a complex and sensitive legal question: Which institutions qualify as religious and can be exempt from the mandate?

For a church, mosque or synagogue, the answer is mostly straightforward. But for the massive network of religious-run social service agencies there is no simple solution. Federal law lays out several criteria for the government to determine which are religious. But in the case of the contraception mandate, critics say Health and Human Services Secretary Kathleen Sebelius chose the narrowest ones. Religious groups that oppose the regulation say it forces people of faith to choose between upholding church doctrine and serving the broader society.

"It's not about preventing women from buying anything themselves, but telling the church what it has to buy, and the potential for that to go further," said Sister Carol Keehan, president of the Catholic Health Association, representing some 600 hospitals.

Keehan's support for the passage of the Obama health care overhaul was critical in the face of intense opposition by the U.S. bishops. She now says the narrowness of the religious exemption in the birth control mandate "has jolted us." She pledged to use a one-year grace period the administration has provided to "pursue a correction."

The U.S. Health and Human Services Department adopted the rule to improve health care for women. Last year, an advisory panel from the Institute of Medicine, which advises the federal government, recommended including birth control on the list of covered services, partly because it promotes maternal and child health by allowing women to space their pregnancies. The regulation includes a religious exemption if an organization qualifies. Under that provision, an employer generally will be considered religious if its main purpose is spreading religious beliefs, and if it largely employs and serves people of the same faith. That means a Catholic parish likely would qualify for a religious exemption; a large church-run soup kitchen probably would not.

Employers that fail to provide health insurance coverage under the federal law could be fined $2,000 per employee per year. The bishops' domestic anti-poverty agency, Catholic Charities, says it employs 70,000 people nationwide. The fine for the University of Notre Dame, the most prominent Catholic school in the country, could be in the millions of dollars.

HHS says employers can appeal a decision on whether they qualify for an exemption. But Hannah Smith, senior counsel for the Becket Fund for Religious Liberty, said, "The mandate vests too much unbridled discretion in the hands of government bureaucrats."

Mandates for birth-control coverage are not entirely new for religious groups. Twenty-eight states already require contraceptive coverage in prescription drug plans. Of those states, 17 offer a range of religious exemptions, while two others provide opt-outs of other kinds. However, opponents of the HHS regulation say there is no state mandate as broad as the new federal rule combined with a religious exemption that is so narrow.

Even in states where the requirement already exists, the issue is far from settled.

Wisconsin's 2009 contraception mandate did not include a religious exemption, but allowed an exception for employers who self-insure. While some dioceses in the state were able to self-insure, others couldn't afford to do so. The Diocese of Madison, Wis., ended up offering a policy with birth-control coverage, but asked employees to follow church teaching and not use the benefit. Local bishops continued to lobby state lawmakers for an exemption. But leaders knew a national health care overhaul was in development and hoped the federal law would be an improvement, said John Huebscher, executive director of the Wisconsin Catholic Conference, the public policy arm of the state's bishops.

In California, whose religious exemption served as the model for the Obama administration, dioceses and some church-run agencies were able to self-insure, said Carol Hogan of the California Catholic Conference, but that option is for the most part unavailable under the federal health care law. Church-run groups could have stopped offering insurance to their employees, but considered that option unfair to workers.

The bishops have responded sharply to the regulation, launching a nationwide campaign against the mandate.

Bishops in more than 140 dioceses issued statements that were read at Mass last weekend. Bishop William Murphy of Rockville Centre, N.Y., called the requirement "a radical incursion on the part of our government into freedom of conscience." Bishop David Zubik of Pittsburgh wrote that "the Obama administration was essentially saying `to hell with you,' particularly to the Catholic community by dismissing our beliefs, our religious freedom and our freedom of conscience."

The Becket Fund had previously filed two federal lawsuits over the regulations on behalf of Belmont Abbey College, a Catholic liberal arts school near Charlotte, N.C., and Colorado Christian University, an evangelical school near Denver. Both challenge the mandate as a violation of several freedoms, including the Religious Freedom Restoration Act, which says the government cannot impose a substantial burden on the free exercise of religion. The fine for Belmont Abbey would be more than $300,000 for the first year, and more than $500,000 for Colorado Christian, Smith, the Becket Fund counsel, said.

Many conservatives are also supporting legislation by Rep. Jeff Fortenberry, R-Neb., that would codify a series of exceptions to the new health care law on religious and conscience grounds

For religious-affiliated employers, the requirement will take effect Aug. 1, 2013, and their workers in most cases will have access to coverage starting Jan. 1, 2014. Women working for secular enterprises, from profit-making companies to government, will have access to the new coverage starting Jan. 1, 2013, in most cases.

Workplace health plans will have to cover all forms of contraception approved by the Food and Drug Administration, ranging from the pill to implantable devices to sterilization. Also covered is the morning-after pill, which can prevent pregnancy after unprotected sex and is considered tantamount to an abortion drug by some religious conservatives.

There is no mandate to cover abortions. But that is little comfort to Catholic leaders, since the regulation violates other church teachings.

White House spokesman Jay Carney said Thursday that the administration will not reconsider the decision.

Langan promoted to men's head coach

[CHARLOTTE] As expected, associate head coach Kevin Langan was named? Charlotte's new head men?s coach, replacing Jeremy Gunn, who left to take the men's job at Stanford.

During Langan?s three years as a member of the 49ers coaching staff, Charlotte won 40 games, reached the 2011 College Cup Final and captured an Atlantic 10 regular-season title.

He will be the seventh head coach in the 36-year history of the 49ers? men?s soccer program.

Langan was promoted from his role as assistant coach last July.

Before moving to Charlotte, Langan spent four years as the head boys coach of the Classics Elite Soccer Academy in San Antonio, Texas. The native of the island of Jersey was a standout player for the University of the Incarnate Word in San Antonio and represented Great Britain at two World University Games.

Mother killed in South African university stampede

A woman has been crushed to death in a stampede for places at a South African university, a stark symptom of how the country is struggling to meet demand for education among the poor.

Thousands of young South Africans and their parents had camped out for 24 hours at the University of Johannesburg to seek its precious remaining slots.

Most were from poor families who learned they were eligible to apply only after receiving the results of their secondary school exams last week.

A melee broke out at about 7.30am. Ihron Rensburg, the university's vice-chancellor, said: "When we opened the gates this morning, we had this unfortunate, this very sad situation, where there was simply an unbearable crush on the front entrance, or front gate."

A mother who had accompanied her son to the campus was killed, he said. "The situation was particularly tragic as the young man was inside the registration tent and had no idea that this had happened."

Three other people were critically injured and nearly 20 others hurt.

Witnesses told how the gate broke and people tried to clamber over the fence. Desmond Mlangu, a prospective student, said he witnessed a "traumatising" scene, with women screaming and people continuing to push.

Hours later, shoes, camping chairs and other detritus was strewn across the site. People remained in line still seeking to join the courses, which begin next month.

Regular admission to the university closed in June, but some places remain open for late entrants. The application process has been open for weeks but many poor students do not have internet access and were unable to apply online.

The university said it had received 7,000 applications in the past 24 hours, of which only 800 would be successful.

The gap is indicative of a strain on South Africa's universities and of a national education system that experts say lurches from one crisis to another, representing arguably the biggest blemish on the African National Congress's record in government.

"This is an absolutely tragic incident but it also shows the desperate situation of poor families, who see university as a way out of poverty," said Salim Vally, the director of the Centre for Education Rights and Transformation at the University of Johannesburg. "It's about race and class. These issues have not been resolved, 17 years after apartheid."

University offers an escape from the prospect of unemployment, which remains the fate of one in three South Africans. There are too many applicants for too few places. This year more than 180,000 would-be students will be turned away from the country's top nine universities, the Times of South Africa reported on Tuesday, including about 74,000 at the University of Johannesburg alone.

Their alternative is further education colleges and other institutions offering vocational skills, but many of these are poorly advertised and of inferior quality.

Rhoda Kadalie, an academic and executive director of the Impumelelo Social Innovations Centre, said the applications logjam was the result of universities closing down in December, a failure to computerise the process, and a continued shortage of universities in South Africa.

It was also too easy to achieve the pass mark for admission, she added. "Too many students are allowed into university who shouldn't be there. We have this warped notion that everyone in South Africa should be able to go to university, irrespective of their marks."

Under apartheid, all but a trickle of the country's black majority was shut out of higher education. When white minority rule ended, in 1994, the gates to universities were opened to all.

But Kadalie believes efforts to increase the number of black students have backfired. "Because of affirmative action, a lot of coloured, Indian and white students aren't admitted. In trying to be politically correct, they are holding students back," she said.

Similar concerns have been raised by Jonathan Jansen, vice-chancellor of the University of the Free State. In a newspaper column last year, he described meeting a school leaver who, despite poor exam marks, was deemed to have fulfilled the minimum requirement for higher education.

"Slowly, slowly we are digging our collective graves as we fall into a sinkhole of mediocrity from which we are unlikely to emerge," Jansen wrote.

"This young (incidentally black) person did not achieve anything above 50% in her Senior Certificate results for any exam subject, but we tell her she can proceed to higher studies. What are we saying? That black students are somehow less capable and therefore need these pathetic results to access higher education?"

Education has been one of the biggest segments of state spending for years, accounting for about 20% of the budget, but it is seen as grossly underperforming, with schools near the bottom in global rankings. The University of Cape Town is South Africa's sole representative, at 103rd, in the Times Higher Education's list of the top 200 universities in the world.

Dr Junita Kloppers-Lourens, the shadow minister of higher education and training for the opposition Democratic Alliance, said: "The situation at the University of Johannesburg is absolutely unacceptable. Last year the minister was asked about the flood of applicants and he said: 'I see it as a wonderful problem.' But today the 'wonderful problem' has turned around into a tragedy.

"The government has failed dismally in dealing with education. It's absolutely criminal, what has happened under the ANC. It will take years to drag it out of the mud."

Parade of Champions

Austin, (TX) - On Saturday night, the Lake Travis Cavaliers held a
huge celebration for several of the Lake Travis High School students.
The football team is making state history for clinching the state
championship for the fifth time in a row.

They are the first high school football team in the state to win 5
state championships in a row.
Parents and community members drove the champs in their convertibles
for the "Parade of Champions".

The high school football team aren't the only ones celebrating.
The Lady Cavs volleyball team captured their second state championship.
The Lady Cavs set a university interscholastic league record with 50
victories and no losses.

"I think anytime you win a state championship in a lot of ways it's a
once and a lifetime opportunity and something to be apart of and these
kids have gone way above and beyond that and to do that 5 years in a
row with all the pressure and everything that goes along with it it's
just something we talk to the kids about," said Head Football Coach
Hank Carter.

"It's amazing I can't even tell you these kids are phenomenal I'm so
proud of what they've done they came in from day one with that
expectation. They trained hard all season to get there and for them
to go undefeated is a huge statement of kind of what they want to do
and what they want to achieve," said Head Volleyball Coach Jennifer
Kazmierski.

The Lake Travis High School Cavalettes just returned home after
performing in the 123rd tournament of rose's parade in Pasadena,
California.
Also the boy's golf team are 2011 State Champs.
The Mighty Cavalier Marching Band, tennis team, are also being
recognized for making it o state competitions this year.
28 seniors were also recognized for being 2011 National Merit
Scholarship Program honorees.

This is the largest number of students ever during a Lake Travis
Parade of Champions.
For this community there couldn't be a better way to kick off this New Year.
